1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Sweet Off ("we," "us," or "our") governing your access to and use of the Sweet Off mobile application for iOS and associated web pages (collectively, the "Service").
By downloading, installing, accessing, or using Sweet Off, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using and uninstall the application.
2. Important Medical & Health Disclaimer
NO MEDICAL ADVICE PROVIDED
Sweet Off is designed exclusively as an educational lifestyle, habit-tracking, and nutritional logging application. Sweet Off is NOT a medical device and does NOT provide medical advice, diagnosis, treatment, or disease prevention.
Content, calculations, scanning outputs (including barcode scanning, optical nutrition label scanning, photo recognition, or food identification), and recommendations within the Service are for general informational purposes only. Never disregard professional medical advice or delay seeking medical treatment because of information obtained through Sweet Off.
Always consult with a qualified physician, nutritionist, or healthcare provider before embarking on any diet, sugar detox, or significant lifestyle modification, especially if you have pre-existing medical conditions such as diabetes, hypoglycemia, eating disorders, or metabolic conditions.
3. Food Scanning & Data Accuracy Disclaimer
Sweet Off includes food, barcode, nutrition label, and ingredient scanning tools. While we strive to maintain accurate data, nutritional information is sourced from automated recognition algorithms, computer vision models, third-party databases, and public nutritional registries.
We make no representations, warranties, or guarantees regarding the accuracy, completeness, timeliness, or reliability of any scanning output (including barcode recognition, label optical character recognition, food photo analysis, sugar calculations, or ingredient identifications). You are solely responsible for inspecting physical food packaging, ingredient lists, and allergen labels prior to consuming any food product.
4. Subscriptions, Billing & Cancellations
Sweet Off offers free core features alongside an optional premium subscription ("Sweet Off Pro").
- Immediate Billing (No Free Trial): Subscriptions are billed immediately upon purchase confirmation through your Apple ID account. Sweet Off does not offer a free trial period.
- Auto-Renewal: Subscriptions automatically renew for consecutive terms unless cancelled at least 24 hours prior to the end of the current billing cycle.
- Apple App Store Management: All payments, subscriptions, and billing transactions are processed exclusively by Apple Inc. You can manage or cancel your subscription at any time via your iOS Device Settings > Apple ID > Subscriptions.
- Refunds: Payments are non-refundable by Sweet Off directly. All refund requests are governed by Apple's Media Services Terms and must be submitted directly to Apple.
5. Intellectual Property Rights
All materials, design elements, software code, food scanning frameworks, computer vision algorithms, branding, logos, trademarks, and content contained within Sweet Off are the exclusive intellectual property of Sweet Off and its licensors.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the app for personal, non-commercial use on compatible iOS devices.
6. Prohibited Activities
You agree not to:
- Decompile, reverse-engineer, disassemble, or attempt to derive the source code of the Service or its scanning algorithms.
- Use automated tools, scrapers, or bots to extract nutritional databases, recognition models, or application data.
- Modify, adapt, translate, or create derivative works based on the Service.
- Use the Service for any commercial purpose or illegal activity.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SWEET OFF, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, HEALTH COMPLICATIONS, LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE OR ITS SCANNING FEATURES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU FOR SWEET OFF PRO SUBSCRIPTIONS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS LESS.
9. Indemnification
You agree to defend, indemnify, and hold harmless Sweet Off and its operators against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your reliance on any scanning output or nutritional data provided through the app.
10. Severability & Changes to Terms
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. We reserve the right to update these Terms at any time, with the updated date reflected above.
